The Ministry of Industry and Information Technology has introduced a new policy on the replacement of electrolytic aluminum production capacity.

Recently, the Ministry of Industry and Information Technology issued the “Notice on Matters Concerning Capacity Replacement by Electrolytic Aluminum Enterprises Through Mergers, Restructuring, and Other Means,” laying out new arrangements for the 2018 electrolytic aluminum capacity‑replacement program.
The Notice states that any project involving the electrolytic production of aluminum liquid, aluminum ingots, or similar products must obtain electrolytic aluminum capacity‑replacement quotas through mergers and reorganizations, intra‑group capacity transfers under a common de facto controller, or trading of capacity‑replacement indicators; it must also formulate a capacity‑replacement plan and implement either equivalent‑capacity or reduced‑capacity replacement.
Indicators eligible for capacity replacement must pertain to compliant production capacity that meets national industrial policies and investment project approval and management requirements. Such capacity must be included in the list of projects reported by the State-owned Assets Supervision and Administration Commission of the State Council and the people’s governments of all provinces to the State Council as part of the special campaign to rectify illegal and non-compliant electrolytic aluminum projects, as summarized in the work‑summary report submitted by October 31, 2017. However, outdated capacity that has already exceeded the nationally mandated phase-out deadline, as well as capacity that was shut down prior to 2013 but was neither listed in the announcements issued by the Ministry of Industry and Information Technology nor in the task‑completion announcements of the provincial people’s governments, shall not be used for replacement. Furthermore, compliant production capacity commissioned on or after October 2017 may also be utilized for capacity replacement. The quantity of capacity shall be determined based on the design capacity stated in the filing or approval documents.
Aluminum electrolysis capacity that was shut down and listed for phase-out between 2011 and 2017 must complete capacity replacement by December 31, 2018; otherwise, such capacity may not be used for replacement.
The electrolytic aluminum production capacity replacement quotas obtained by enterprises shall be prioritized for use in their existing construction projects that have yet to complete capacity replacement; in principle, such quotas may not be allocated to other newly initiated construction projects if the existing projects have not yet completed their capacity replacement.
This notice shall take effect as of January 1, 2018. In the event of any inconsistency between this notice and previously issued documents of the Ministry of Industry and Information Technology concerning the replacement of electrolytic aluminum production capacity, this notice shall prevail.
