Regulations on Work Safety for Metallurgical Enterprises and Nonferrous Metal Enterprises Issued

On January 4, the State Administration of Work Safety issued the Regulations on Work Safety for Metallurgical and Nonferrous Metal Enterprises, aimed at standardizing the supervision and management of work safety in these industries and ensuring that enterprises assume their primary responsibility for work safety.

The Regulations standardize corporate conduct by requiring enterprises to fully implement safety production safeguards, establish a safety production responsibility system, put in place a dual-prevention mechanism for risk control and hazard identification and remediation, and improve the organizational structure and staffing for safety production management. In addition, the Regulations set forth specific technical safety requirements for processing operations such as high-temperature molten-metal smelting, leaching, and extraction.

 

Departments responsible for safety production supervision shall, in accordance with the law, strengthen oversight and inspection of enterprises’ safety production activities; clearly designate the competent authority for safety production supervision and management of each enterprise; promptly address any identified potential hazards; and place major potential hazards under supervised rectification with public signage. The progress of standardizing enterprises’ safety production practices, establishing a dual-prevention mechanism for managing safety production risks and identifying and addressing hazards, shall be incorporated into the annual safety production oversight and inspection plan, and inspections and guidance shall be carried out in accordance with this plan to ensure that enterprises implement these measures. Furthermore, training on specialized knowledge of safety production shall be strengthened for oversight and inspection personnel to enhance their administrative law enforcement capabilities; and personnel conducting oversight and inspection at specific work sites must be equipped with necessary personal protective equipment and monitoring and inspection instruments.

 

These Provisions shall come into force on March 1, 2018, and the Regulations on the Supervision and Administration of Work Safety in Metallurgical Enterprises, promulgated by the State Administration of Work Safety on September 8, 2009, shall be concurrently repealed.
